Oh shiz! TMZ is confirming that Tom Cruise and Katie Holmes are getting a divorce aka Katie’s contract has expired!

Tom, 49, and Katie, 33, have been married for five years. In fact, Katie’s attorney is also confirming the news.

Katie’s lawyer, Jonathan Wolfe released a statement saying, “This is a personal and private matter for Katie and her family.”  He adds: “Katie’s primary concern remains, as it always has been, her daughter’s best interest.”

Tom and Katie have a prenup, with the couple’s net-worth totaling about $275 mil (mostly all of Tom’s money).

Tom and Katie have been plagued with split rumors for the past couple of weeks as the last time they were seen together in public was back in February. Plus Katie did not attend any of the “Rock of Ages” premieres this month.

As for what led to the split, a mid-May report from In Touch weekly stated Katie was depressed and unhappy in her marriage. Sources close to her revealed she was lonely (with Tom being away so much due to work) and her life with Tom wasn’t what she imagined it would be.

Katie was also sad with the state of her career as she believed being married to Tom would bring her more opportunities.

It doesn’t help that Tom has been plagued with gay rumors for years and years, with most believing this marriage wasn’t real to begin with and that Katie didn’t really have a mind of her own. Who knows?

Tom and Katie have a daughter together, Suri, who is 6-years-old. Katie and Suri have been spotted in New York City this week.
