Colorado movie theater shooter James Holmes made his first appearance in court on Monday (July 23).

The 24-year-old former medical student was officially informed by a judge that he’s being held on suspicion of first-degree murder.

James appeared in court with his hair dyed orange and looking unkempt. He seemed dazed through the appearance and appeared to be putting on his own crazy act by constantly opening his eyes widely and then seemingly dozing off while the judge was speaking, also blinking widely at other times.

He left the court room following a brief 15-minute appearance in shackles. As reported over the weekend, James is being held in solitary confinement at a Colorado jail as other inmates have threatened to kill him.

Prosecutors have yet to decide if they will seek the death penalty for James, who stands accused of killing 12 people and injuring 58 at an opening night screening of “The Dark Knight Rises” on Friday.  Formal charges will be presented on Monday, July 30.
